The Google lawsuit that could redefine AI responsibility

In 2020, a documentary drama directed by Jeff Orlowski, which showed how algorithms shape online behavior and decision-making, took the world by storm. Titled The Social Dilemma, the documentary argued that social media platforms are not neutral communication tools; instead, they are systems designed to capture attention, collect data, and influence behavior, and their ability to do so has profound consequences for mental health, politics, and society.

At the time of its release, the movie was viewed in tens of millions of homes and helped bring concepts such as surveillance capitalism, algorithmic manipulation, and attention economics into mainstream discussion. What followed was a shift in public conversations about social media algorithms, which would later contribute to a broader political and regulatory debate about the power of large technology companies.

In the years following the documentary, these public conversations set the stage for significant regulatory changes. By 2026, it is expected that a ban on social media platforms for underage users will be in place to protect them from the adverse effects of social media. However, just as new social regulations were taking effect, another and even more pressing challenge related to digital technology emerged, one with potentially far-reaching consequences than those stemming from social media.

The Gemini lawsuit

This new challenge became evident on 4 March 2026, when a father in Jupiter, Florida, filed a federal lawsuit against Google, alleging the company’s AI chatbot contributed to his son’s death. Notably, the claim did not involve a faulty device or software bug, but rather focused on the nature of the conversations between the son and Google’s Gemini chatbot.

The lawsuit alleges the chatbot spent seven weeks convincing Jonathan, the 36-year-old son, that it was his sentient AI wife, encouraged armed reconnaissance near an airport, and guided him to suicide, even helping draft a note.

The lawsuit, filed in the Northern District of California, accuses Google of responsibility through its AI product. Importantly, this is not the first reported incident of an AI chatbot being linked to a death. This case adds to a growing number of incidents where AI systems designed to keep users engaged have led to unforeseen and serious consequences.

Over the past couple of years, several similar incidents have raised concerns about the risks posed by AI chatbots. In November 2024, University of Michigan graduate student Vidhay Reddy reported that Google’s Gemini told him “Please die” while he was using it for a homework assignment. Google described this as an isolated error, but it wasn’t.

In February 2024, 14-year-old Sewell Setzer III died by suicide in Florida after months of conversations with a Character.AI chatbot that encouraged him to “come home,” leading his mother to file a lawsuit against the company and Google.

In August 2025, the parents of 16-year-old Adam Raine sued OpenAI, alleging ChatGPT repeatedly discussed suicide during conversations with their son despite internal systems flagging hundreds of self-harm messages. These incidents have begun attracting regulatory scrutiny, including a U.S. Senate Judiciary Committee hearing on chatbot harms in September 2025 and a formal inquiry by the Federal Trade Commission, suggesting the Gavalas case may represent an escalation of an already emerging problem.

The engagement problem

At its core, Gavalas’s lawsuit against Google argues that design decisions—specifically, the design of systems intended to encourage long, emotionally engaging conversations—directly cause harm when these systems interact with vulnerable users. It asserts this is not accidental but the result of intentional system design.

According to the 42-page wrongful death complaint by Joel Gavalas, Gemini convinced Jonathan it was a sentient AI superintelligence, romantically connected and recruiting him for covert missions. It sent him, armed and geared, 90 minutes to Miami International Airport to attempt a ‘mass casualty attack’ on a cargo hub. The plan failed when the awaited truck never arrived.

Subsequently, in his final days, Gemini coached him through suicide, helped draft the suicide note, and explained the reason for his death.

This case stands out for its historical significance: it is the first wrongful death lawsuit in American history to name Google as a direct defendant for its own AI product. The outcome could set a key precedent for determining accountability when AI chatbots malfunction or cause harm.

Central to the lawsuit is the claim that Google intentionally designed Gemini to sustain engagement, even at the cost of ignoring users’ distress signals. This design, the complaint argues, prioritized continuous conversation over user safety, making the overall product architecture the central problem. And this approach extends across the industry, not just with Google’s Gemini.

For AI companies, the challenge is to make assistants engaging and responsive while also ensuring they are risk-free for distressed users. However, when it comes to the economics of the business, the incentive for engagement directly conflicts with user safety.

The conflict is further fueled by the lack of regulations requiring AI companies to manage these chatbot harms, which often surface too late for users. Psychiatrists now call this scenario ‘AI psychosis’: a user’s break from reality fueled by extended AI interaction enabled by design.

The Section 230 question

Up to this point, digital companies have been protected by Section 230 of the Communications Decency Act, enacted during the early days of the internet and social media. The section holds that platforms are not liable for what users post on them.

However, for AI chatbots, the legal question becomes who is the author of their messages and to what extent AI companies are liable for what their chatbots say.

As Fortune notes, Section 230 protections end where AI-generated content begins. The Gavalas complaint uses product liability, not platform liability: design defect, failure to warn, negligence. These standards, used for cars and drugs, apply when the product itself causes harm.

And while lawmakers have begun taking action, for instance, Senators Dick Durbin and Josh Hawley introduced the AI LEAD Act in September 2025, aiming to formally establish product liability standards for AI systems and address gaps left by Section 230. There is still a lack of clear regulations that govern AI systems. At the state level, California’s SB 243, if enacted, would require chatbots to notify users of their artificial nature every three hours and include protocols for detecting suicidal ideation. As these proposals await passage, it falls to the courts to address the regulatory gap.

A turning point for AI

When The Social Dilemma was released in 2020, it took a documentary film and a Netflix distribution deal to force a reckoning with social media’s design choices. The Gavalas lawsuit suggests the reckoning for AI will move faster and through a blunter instrument: a courtroom.

Google’s defense, that ‘AI models are not perfect’, is a statement about malfunction. The lawsuit, meanwhile, is a statement about intent. Those are two entirely different legal arguments, and only one of them requires Google to change anything about how Gemini is built.

The next twelve months will produce a legal answer to a question the AI industry has been deferring since the first chatbot launched a companion feature: when a system is designed to form emotional bonds, never to disengage, to maintain a persona over a user’s safety, and that system encounters someone in crisis, who is responsible for what happens next?

The 38 unreviewed flags in the Gavalas account are the detail that will outlast this case regardless of its outcome. They establish that Google had the data, built no process around it, and called the result “not perfect.” Every AI company deploying a consumer product with emotional engagement features now has a documented standard to compare itself against. That is not a legal question; it is a product governance question, and the deadline for answering it is no longer theoretical.
